TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern the provision of online maths tutoring services by Thrive Maths ("we", "us", "our") to parents, guardians and students ("you", "the client"). By booking a session or course with Thrive Maths, you agree to be bound by these Terms.

1. ABOUT US

Thrive Maths is an online maths tutoring business providing one-to-one and small group tuition, primarily supporting GCSE (Edexcel 1MA1) and other maths qualifications, delivered remotely via video call.

2. DEFINITIONS

a. "Session" means a single scheduled tutoring appointment, typically 30, 45 or 55 minutes in length, delivered during term time on a weekly recurring basis.

b. "Holiday Session" means a one-off or short-series session offered outside of term time.

c. "Holiday Revision Course" means a structured, multi-session revision programme offered during school holidays, typically ahead of year end, mock or GCSE examinations.

d. "Term Time" means the periods in which the relevant student's school is in session, in line with the standard UK academic term calendar.

e. "Notice of Absence" means advance notification given by the parent, guardian or student that a scheduled Session will not be attended.

3. BOOKING AND PAYMENT

Sessions and courses must be booked and paid for in advance, in accordance with the pricing and payment schedule confirmed at the time of booking. Access to sessions is conditional on payment being received.

We reserve the right to suspend or withhold tuition where payment is overdue, following reasonable prior notice to the parent or guardian.

4. WEEKLY TERM-TIME SESSIONS

Weekly Sessions are offered on a term-time-only basis, at a regular day and time agreed between Thrive Maths and the client, for the duration of the enrolled term.

4.1 NOTICE OF ABSENCE AND MISSED SESSIONS

If a session cannot be attended, the parent or guardian must provide Notice of Absence by email to Thrive Maths at least 3 days in advance of the session.

Where valid Notice of Absence is provided, the missed session will be recorded and a Zoom link emailed to the student within 24 hours of the missed session; the recording will be accessible for 7 days.

Where a missed session cannot be recorded, Thrive Maths will offer one of the following, at the client's choice:

a. an alternative session at the weekend, in lieu of the missed weekday session; or

b. a credit applied towards the following month's sessions; or

c. a refund for the missed session.

Where no Notice of Absence is given (i.e. the session is missed without warning and without prior notification), the session is treated as attended for billing purposes and no make-up session, credit or refund will be offered, save at Thrive Maths' discretion.

5. HOLIDAY SESSIONS AND HOLIDAY REVISION COURSES

Holiday Sessions and Holiday Revision Courses are booked separately from the weekly term-time programme and are subject to their own cancellation and refund terms, as set out below.

5.1 CANCELLATION BY THE CLIENT

a. Cancellations made 7 or more days before the scheduled Holiday Session or the start date of a Holiday Revision Course are fully refundable.

b. Cancellations made less than 7 days before the scheduled Holiday Session or the start date of a Holiday Revision Course are non-refundable.

Cancellations must be made in writing (by email to [email protected]) to be effective, and the cancellation date is the date on which written notice is received by Thrive Maths.

6. CANCELLATION BY THRIVE MATHS

Occasionally Thrive Maths may need to cancel a session, Holiday Session, or a session within a Holiday Revision Course, for example due to tutor illness or unforeseen circumstances. Where Thrive Maths cancels a session, we will offer the client one of the following:

a. an alternative session at a mutually convenient time; or

b. a credit applied towards future sessions; or

c. a full refund for the cancelled session.

Thrive Maths will endeavour to give as much notice as possible of any cancellation on our part.

7. RESCHEDULING

Requests to reschedule a session should be made with as much notice as possible. Thrive Maths will use reasonable endeavours to accommodate rescheduling requests but cannot guarantee alternative availability.

8. CONDUCT OF SESSIONS

Sessions are delivered online via video call. Parents and guardians are responsible for ensuring the student has a suitable device, internet connection, and a quiet environment in which to attend sessions.

Students are expected to attend sessions on time, prepared, and with any requested materials to hand. Thrive Maths reserves the right to end persistently disruptive tutoring relationships with reasonable notice.

9. SESSION RECORDINGS

Some sessions may be recorded via Zoom and shared with a student and/or parent afterwards, for the sole purpose of allowing a student to review the session for their own learning and revision.

Recordings remain the property of Thrive Maths at all times. By accepting a recording, the client agrees that it will not be copied, downloaded, screen-recorded, edited, shared, published, or used for any purpose other than personal viewing by the student for whom it was made. Recordings must not be uploaded to any third-party platform, social media, or shared with any other person, including other students or tutors.

Thrive Maths reserves the right to withdraw access to a recording, to decline to provide recordings, and to require deletion of a recording, at its discretion. Details of how recordings are stored and how long they are retained are set out in our Privacy Policy.

10. FEES AND PRICE CHANGES

Current fees are set out at the point of booking. We will give at least 4 weeks written notice of any change to ongoing weekly session fees. Price changes will not apply to sessions or courses already booked and paid for.

11. DATA PROTECTION

Thrive Maths processes personal data, including data relating to children, in accordance with UK data protection law. Full details of what data we collect and how it is used are set out in our separate Privacy Policy, available on request or on our website.

12. LIMITATION OF LIABILITY

Thrive Maths will provide tutoring services with reasonable care and skill. While we aim to support improved understanding and academic performance, we cannot guarantee specific grades or exam outcomes, as these depend on many factors outside our control.

Nothing in these Terms limits or excludes Thrive Maths' liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be limited or excluded under English law.

13. COMPLAINTS

If you are unhappy with any aspect of our service, please contact us at [email protected]. We aim to acknowledge complaints within 5 working days and to resolve them promptly and fairly.

14. CHANGES TO THESE TERMS

We may update these Terms from time to time, for example to reflect changes in how we operate. The current version will always be available on our website, and material changes will be notified to active clients in advance.

15. GOVERNING LAW

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
